By accessing or using the Service you (“The User”) agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access this Service.
Content
Our Service allows you to view and download certain information or other material (“Content”). The User understands that functionality of the Service will vary dependent on what permissions the User holds with Sernova Financial (“Sernova”) or clients of Sernova. Availability, accessibility, reliability and integrity
Sernova will strive to ensure that the Service will be available, accessible and reliable at any time and that the Service will have sufficient integrity.
Modifications to the Service
Sernova may at any time and without prior written notice, add, remove and/or modify functionality in the Service.
Beta Versions
Sernova may from time to time add new functionalities to the Service in the form of beta versions. All such beta versions are provided on an “as is” basis and to the extent available. Sernova will have no liability for functionality provided as beta versions.
Use of the Service
The User agrees not to use the Service in a manner that violates any laws, regulations and decisions by any supervising authority, or in a manner that creates damage or inconvenience to any third party (including you or your clients). The User is aware of that any unlawful use of the Service, such as gaining access to another company’s data, may be subject to criminal liability and/or a liability to pay damages.
The User will access the Service via an internet connection only. The User is responsible for using the appropriate equipment, including but not limited to the necessary internet connectivity, computer hardware, operating systems and web browser applications. Sernova has no responsibility or liability for any connection to the Service.
User Authorisation
In order to access the Service, each User will need a User Account registered with the Service. The User acknowledges that Sernova may user various methods to verify the identity of Users (including services from third parties) and that Sernova may from time to time change the method and application for user identity verification.
The User understands that User Accounts are intended to be personal to each User, meaning that the User shall in no event lend, borrow or otherwise share their User Account information with another User or with any third party.
In the event that the User becomes aware of any unauthorized use of any User Account or that any unauthorized user has gained access to passwords or other identification measure relating to the User Account, the User undertakes to immediately notify Sernova about such occasions.
Blocking a User Account
If Sernova has reasonable grounds to believe that a User uses a User Account in breach of these Terms and/or of any specific instructions, Sernova shall have the right, but not the obligation, to immediately and without prior notice block the relevant User Account. Similarly, Sernova shall also have the right, but not the obligation, to block a User Account if Sernova has reasonable grounds to believe that a User is acting in a manner that may cause damage to Sernova or any third party (including in case of repeated login failures or in case Sernova suspects unauthorised use of a User Account).
Limitation of Liability
Force Majeure
Sernova shall not be liable for any damage, third party claims, claims from governmental authorities, costs, damages, liquidated damages, losses and liabilities that arise due to events of an extraordinary nature, including but not limited to war, rebellion, civil disorder, mobilization, general energy disruption, confiscation, monetary restrictions and authority intervention.
Use of the Service
Sernova shall not be liable for any damage, third party claims, claims from governmental authorities, costs, damages, liquidated damages, losses and liabilities that arise as a result of the use of the Service by the User or any third party.
Sernova does not warranty the use of Services other than under a contract between Sernova and the User or User legal entity if applicable.
Third Party Information
The User is aware of that the Service may include and provide information provided by third parties. The User acknowledges that Sernova will have no liability as regards this information or the correctness of such third party information or for any damage, third party claims, claims from governmental authorities, costs, damages, liquidated damages, losses and liabilities that arise as a result of errors, faults mistakes or in such information. Sernova reserves the right to at any point in time and without prior written notice cease the provision of such third party information in the Service or to change the nature and/or composition of the information.

Revision of these Terms
Sernova reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Confidentiality
The User undertakes not to disclose or make available the contents of the Service, to any third party unless explicitly permitted according to these Terms, or if required by applicable law, or if requested by a supervising authority, or if disclosure is indispensable to give the User the full benefit of the Service under a contract between Sernova and the User or the User legal entity. The provision in this clause shall not prevent the User from disclosing information about the Service with any of its employees, in each case on a need-to-know basis.
